The 5th Circuit Court of Appeals has struck down a Texas law that would ban state funds from going to Planned Parenthood. The three-judge panel ruled on Friday that prohibiting the abortion provider from participating in state Medicaid programs would not be constitutional.
On Monday, April 30th, District Judge Lee Yeakel issued an injunction against the ban on government funding, which was then overturned the following day by Circuit Judge Jerry Smith. However, the 5th Circuit has now once again discarded of the prohibition, and the state is considering whether or not to proceed with an appeal.
On the same day, Arizona Governor Jan Brewer also signed a bill into law that ends government assistance to Planned Parenthood in her state, making it the sixth state in the nation to override the federal government’s “legalized” funding of the abortion provider.
